A California State Court of Appeals has said that an insurer can suspend AIDS-related disability coverage because the policy holder knew his HIV status when he originally bought the policy. Paul Galanty purchased disability income insurance from Paul Revere Life Insurance Company in March 1989, which was 18 months after testing positive for HIV. When Galanty filed a disability claim in August 1994, Paul Revere requested medical records regarding Galanty's HIV status. When Galanty refused to provide the records, Paul Revere suspended payments to Galanty, stating that his claim was regarding a pre-existing condition.
