Dr. James R. Sweet sued the Utter Co. for publishing an ad in the newspaper that advertised him as a dentist whose specialty was treating HIV-positive patients. The dentist claimed the newspaper was guilty of negligence and reckless behavior, because the newspaper did not investigate whether the claims were true. A Connecticut Superior Court sided with the newspaper, stating that even if there was proof that the purpose of the ad was to damage Sweet's practice, the ad was not actually libel per se.
