MASSACHUSETTS: Judge to Hear New Hampshire Hepatitis C Records Dispute on October 17

A judge will hear an evidentiary dispute over access to medical records in a case between the state of New Hampshire and Exeter Hospital following a hepatitis C outbreak, after an infected hospital lab worker allegedly stole drugs from the hospital and substituted infected syringes that were then used on patients. At least 32 patients have been diagnosed with the same strain of hepatitis C that the lab worker has. The hospital has asked the court to prevent the state from gaining further access to patient records and staff interviews, unless the state is more specific in its requests for evidence. The attorney general’s office has filed an objection and requested a hearing, contending that hospitals are required by law to provide information during investigations focused on communicable diseases.
