A federal jury has awarded $590,600 to a former Ramsey County, Minn., inmate who became seriously ill with TB while incarcerated. The jury determined on December 10 that public health nurse Mary Clausen was “deliberately indifferent” to the condition of Marchello McCaster, who lost 44 pounds while serving a 56-day sentence during 2008. Robert Bennett, McCaster’s attorney, informed the Star Tribune that the award is half for compensation and half for punitive damages, and that the county will be responsible for paying the award since Clausen was a county employee. The county has already settled an earlier lawsuit brought by inmates who were exposed to McCaster’s TB for approximately $16 million.
