OHIO: Justice Dept. Scores Another Win Against HIV Discrimination

The Gleinbeigh Hospital of Rock Creek, Ohio, has settled a lawsuit with the US Justice Department after the hospital refused services to an HIV-positive individual, which is illegal under the Americans With Disabilities Act. A patient was refused admittance to Gleinbeigh Hospital’s alcohol treatment program because of their HIV-positive status after officials claimed that side effects from the patient’s HIV medications would put other individuals in the program at risk. The Justice Department determined that the hospital could not prove its claims that the patient would have posed a risk to the health and safety of others and is requiring Glenbeigh to pay $32,000 to the complainant and another $5,000 in civil penalties. Assistant attorney general for the Justice Department’s Civil Rights Division Thomas Perez stated, “The ADA does not tolerate HIV discrimination and neither will the Justice Department.”
