[TITLE:] Juridical response as opposed to the AIDS

[ABSTRACT:] Issues: The lack of information brings over of the AIDS in the different actors involved in its struggle, is converted into a great limitation that does not allow to achieve the goals of the national programs, specially in the protection of the human rights of the PVVS.

DESCRIPTION: The epidemic of the AIDS in the Peru, still is considered only as a problem of public health and not as a problem of development and that it affects the human rights of the PVVS. In the struggle against the AIDS new social actors emerge, one of them is the judicial power.

The responsibilities derived from the cases of AIDS (blood transfusion, discrimination, etc.), they have originated that the affected parts come to the administration of justice to consider that their fundamental rights have been damaged. The principal limitation in the struggle against the AIDS is the disinformation and comprehension prejuiciosa of it, by what it is asked to give special attention, in the measurement in which the justices need to possess information relative to the AIDS to base due& their decisions.

Learned lessons: a) The justices recognize to the human rights as fundamental tool in the struggle against the AIDS; b) they have identified themselves emptinesses and legal limitations and offers have been generated for the judicial treatment of the cases of AIDS; c) they have been defined political on the legal treatment of the AIDS, d) there have been helped to reach the goals of the declaration of commitment of the VIH and AIDS of the UNGASS.

RECOMMENDATIONS: To continue with the identification and sensitization of social actors that still(yet) do not sit down identified with the AIDS; b) to qualify the students of right brings over of the AIDS and his(its,her) effects in the legislation and human rights, c) to continue with the interchange of experiences to unify the jurisprudence relative to the AIDS.
